What is Personal Injury Protection (PIP)?
PIP, or “No-Fault” car insurance, is a type of insurance every vehicle owner in the State of Florida is required to carry. PIP provides $10,000.00 in medical benefits to the victims of car accidents regardless of who is at fault for the accident.
What is covered by PIP?
PIP insurance covers medical expenses, lost wages and provides a death benefit.
- PIP provides up to $10,000.00 to pay for medical expenses for reasonable, medically necessary treatment related to a motor vehicle accident. PIP pays 80% of the reasonable medical expenses.
- PIP covers the owner of the vehicle, resident relatives and the occupants of the vehicle after an accident. PIP insurance is primary over any other type of insurance after an accident including health insurance and the bodily injury insurance of the at fault party.
- PIP provides $2,500.00 when a car accident victim does not have an emergency medical condition.
- PIP provides $10,000.00 when a car accident victim has an emergency medical condition.
In the State of Florida, you must seek treatment within 14 days of the accident in order to use your PIP coverage. If you’ve been in an accident, and you haven’t sought medical treatment yet, call Myones Legal at (954) 668-3180 or fill out this form for a free consultation so we can explain your rights after an accident.
How do I make sure I get all my PIP benefits?
Insurance companies spend millions of dollars a year paying investigators and lawyers to find a way to deny injured Floridian’s claims after an accident. Most of the time, the insurance companies rely on “legalese” insurance policy language to deny your claim, or even worse, cancel your policy. It’s important to understand both your rights and your responsibilities as an insured after a car accident.
Your insurance policy contains a number of conditions you must comply with in order to receive PIP coverage.
Independent Medical Examination (IME)
Many insurance companies do not want to continue to pay for the medical treatment you receive after an accident even though you’re injured. In order to avoid paying for the medical treatment, they hire a doctor to examine you to say that you are recovered and no longer need to treat. At Myones Legal, we fight the insurance companies when they rely on these Peer Reviews and Independent Medical Examinations because the doctors are paid directly by the insurance company to say you’re not hurt and don’t need any more treatment. But did you know that if you miss this appointment, the insurance company is off the hook for paying for ANY of your treatment? Missing one IME appointment cancels out the rest of your claim. If you have received a Florida IME notice and don’t know what it means, contact Myones Legal at (954) 668-3180 or this form and we will walk you through the process.
Examination Under Oath (EUO)
Another condition in insurance policies is the right for insurance company’s to take recorded statements and perform Examinations Under Oath. An EUO is a sworn recorded statement taken by an insurance adjuster or lawyer to gather facts and try to find reasons to deny your claim. Many times, if an injured person shows up to an EUO without being represented by counsel, the adjuster or lawyer for the insurance company will do anything they can to take advantage of the unrepresented person. Moreover, if you get an EUO notice and do not appear at the time and place picked by the insurance company, the insurance company can deny your claim for that reason alone. If you’ve been in a car accident and receive an EUO notice, call Myones Legal at (954) 668-3180 or fill out this form and we will explain your options regarding Examinations Under Oath.
Types of Providers Covered by PIP
PIP covers 80% of reasonable medical expenses for all medical, surgical, x-ray, dental and rehabilitative services, including prosthetic devices and ambulance, hospital, and nursing services. That means after an accident, you can treat with:
- Urgent Care
- Outpatient Treatment
- Physical Therapist
- CT Scan
- Orthopedic Surgeon
- Interventional Pain Specialist
- General Practitioner
What is NOT Covered by PIP
PIP Coverage does not pay for massage or acupuncture services and you cannot seek treatment with a licensed massage therapist under your PIP coverage.

He did so and figured out that I was in the right, immediately contacted Windhaven, started a lawsuit against them, and 1 got him to acknowledge that they were wrong, and got them to settle pay out the claim and pay me so I’m extremely happy and I would definitely recommend Howard.”
